Lockheed Martin Corporation and our subsidiaries worldwide (“Lockheed Martin” or “we”) are committed to complying with data protection legislation, including the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) and the California Consumer Privacy Act (“CCPA”)/California Privacy Rights Act (“CPRA”).

This Job Applicant Privacy Notice applies to all individuals who have expressed interest in joining our talent network or have applied to any job postings of Lockheed Martin Corporation and/or its affiliates globally (collectively referred to as "Lockheed Martin", "we", "us"). This notice outlines how we will process your personal information in compliance with applicable data protection laws.

This privacy notice explains how we collect, use, and share your personal information, including:

PERSONAL INFORMATION WE COLLECT

When you apply for a job or express interest in working at Lockheed Martin, we will ask you to provide us with personal information about yourself so we can evaluate your application or reach out to you about employment opportunities. If this information is not provided, our ability to consider you as a candidate may be limited. All information is provided on a voluntary basis and you determine the extent of information that you provide to us.

When we collect information

We collect information about you if you provide your personal information to us as part of your job search.

We will collect your personal information via the following methods:

  • by you submitting your information on our careers website, which is hosted in the U.S.;
  • through your communications with us via emails or phone calls.

 Resume/CV Information

 Biography with work history, photo, education, security clearance information, and other professional employment-related information such as skills and salary preferences

 Accommodation Information

 If you progress through the recruitment process, you will receive a form to request a reasonable accommodation for any disabilities, if needed, for the selection phase.

 

New hires and rehires may be required to complete a background and screening check, including but not limited to, criminal history and drug test where required by the role and as permitted by local law.

The legal basis for using your Personal Information

We will only collect, use and share your personal information where we have an appropriate legal basis to do so. This may be because:

  • you have provided your consent to us using your personal information;
  • our use of your personal information is in our legitimate interest (for example our legitimate interest in communicating with you—in these cases we will look after your information at all times in a way that is proportionate and respects your privacy rights, and you have a right to object to processing as explained in this notice);
  • our use of your personal information is necessary to perform a contract or take steps to enter into a contract with you; and/or
  • our use of your personal information is necessary to comply with a relevant legal or regulatory obligations that we have; for example, fulfilment of a court order.

 

SHARING YOUR PERSONAL INFORMATION

Except as set out in the bullet points below, Lockheed Martin does not sell or share your personal information with third parties except with respect to the potential limited data processing activities necessary to carry out and deliver our services, or as otherwise required by applicable law. If any such sale or sharing occurs, we will post a "Do Not Sell or Share My Personal Information" link and provide suitable means for users to opt-out.

We do share your information in the manner and for the purposes described below:

  • within Lockheed Martin, where such disclosure is necessary to provide you with our services or to manage our business;
  • with third parties who help manage our business and deliver recruitment-related services. These third parties have agreed to confidentiality restrictions and use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us. These include IT service providers. We use third party IT service providers to host our recruitment tools and this includes use of third party AI where you ask for job recommendations against your resume/CV;
  • with our regulators, to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies; and/or
  • if, in the future, we sell or transfer some or all of our business or assets to a third party, we may disclose information to a potential or actual third-party purchaser of our business or assets.


TRANSFERRING PERSONAL INFORMATION GLOBALLY

Lockheed Martin operates on a global basis. Accordingly, your personal information may be transferred and stored in the countries in which we operate. Lockheed Martin will take appropriate steps to ensure that transfers of personal information are in accordance with applicable law and carefully managed to protect your privacy rights and interests and transfers are limited to countries which are recognized as providing an adequate level of legal protection or where we can be satisfied that alternative arrangements are in place to protect your privacy rights. To this end:

  • we ensure transfers within Lockheed Martin will be covered by an agreement entered into by members of Lockheed Martin (an intra-group agreement) which contractually obliges each member to ensure that personal information receives an adequate and consistent level of protection wherever it is transferred within Lockheed Martin;
  • where we transfer your personal information outside Lockheed Martin or to third parties who help provide our products and services to the company, we obtain contractual commitments from them to protect your personal information;
  • where we receive requests for information from law enforcement or regulators, we carefully validate these requests before any personal information is  disclosed.

Lockheed Martin complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF.  As set forth by the U.S. Department of Commerce, Lockheed Martin has certified adherence to the EU-U.S. DPF Principles and UK Extension with respect to the processing of personal information received from the European Union (EU) and United Kingdom (UK). YOUR PRIVACY RIGHTS

We respect your privacy rights related to the personal information that we collect, use, and disclose about you. Depending on your state, region, or country, you may have certain privacy rights regarding the personal information we process. Your privacy rights may include, based on applicable law:

  • The right to access and/or obtain a copy of the personal information we store about you in a portable and readily usable form;
  • The right to rectify or erase the personal information we store about you;
  • The right to restrict or object to the processing of your personal information; and
  • The right to have your personal information transferred.

 

We may not always be able to fully address your request, for example if it would impact the duty of confidentiality we owe to others or if we are legally entitled to maintain or deal with the request in a different way.

In certain circumstances, we may require you to verify your identity before we fulfill your request. As a part of this verification process, government identification may be required. You may designate an authorized agent to make a request under applicable law on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney and the requester’s valid government-issued identification.

Job Applicants in California
If you are a resident of California as defined in the California Code of Regulations (18 CCR § 17014), you have the rights described in the Your Privacy Rights section of this notice as granted under the California Consumer Privacy Act of 2018 (“CCPA”) and the California Privacy Rights Act (“CPRA”), collectively, “California Privacy Law.”

As defined by California’s ‘Shine the Light Law,’ California residents may annually request and obtain information free of charge about what personal information is disclosed to third-parties for direct marketing use within the prior calendar year. Lockheed Martin does not sell or share your personal information with other businesses for direct marketing.

Job Applicants in the UK and EU (EEA)
If you are a job applicant in the EU, you have a right to lodge a complaint with your local supervisory authority if you have concerns about how we are processing your personal information.  Job applicants in the UK can contact the United Kingdom Information Commissioner’s Office (ICO).

ARTIFICIAL INTELLIGENCE AND AUTOMATED DECISION-MAKING TECHNOLOGIES

Lockheed Martin may utilize artificial intelligence to process your personal information as part of the job applicant process for data and statistical analysis. Automated decision-making technologies may be used by us for the purpose of enabling certain global-level recruiting analysis and diversity monitoring, with your consent where permitted by applicable law, to comply with legal requirements or in Lockheed Martin’s legitimate interests.  Job applicants will not be subject to decisions that will have a significant impact on them based solely on automated decision-making. We ensure that artificial intelligence is utilized in an ethical, fair, and accurate way.

Security of Personal Information

As the security of information depends in part on the security of the computer you use to communicate with us and use to protect your User IDs and passwords, please take appropriate measures to protect this information.

Storing your Personal Information

We will store your personal information for as long as is reasonably necessary for the purposes for which it was collected, as explained in this notice. In some circumstances we may store your personal information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements.

To comply with applicable legal or internal policy requirements, we will retain job applicant data for the duration of the recruitment process. Information for unsuccessful candidates will be retained in accordance with our records retention schedule and applicable regulations.

In specific circumstances we may store your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your personal information or dealings.
